01 Acceptance of Terms

By accessing or using the services provided by Kapaz Cafe ("we", "us", "our"), including our website, mobile applications, booking systems, and on-site facilities, you agree to comply with and be bound by these Terms of Service.

If you do not agree to these terms, you must not use our services. Your continued use of our services constitutes your acceptance of any updated or modified terms.

02 Definitions

• "Account" means a registered user account on our platform.
• "Booking" means a reservation of a room, table, fleet asset, activity, or service.
• "Content" means text, images, video, audio, and other materials available on our platform.
• "Guest" means any person staying at or visiting our lodge.
• "Services" means all services offered by Kapaz Cafe, including accommodation, dining, fleet hire, activities, and online bookings.
• "User" means any person accessing our services, whether registered or not.

03 Eligibility

To use our services, you must:

• Be at least 16 years of age to create an account.
• Be at least 18 years of age to book accommodation, fleet assets, or activities without a guardian.
• Provide accurate, current, and complete information during registration.
• Have the legal capacity to enter into a binding agreement.

If you are under 18, you may only use our services with the involvement of a parent or legal guardian who agrees to these terms.

04 User Accounts

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to:

• Provide accurate and up-to-date information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized use of your account.
• Not share your account with others.
• Not create multiple accounts for fraudulent purposes.

05 Bookings & Reservations

All bookings are subject to availability and confirmation. A booking is only guaranteed once you receive a confirmation from us.

• Guests must present valid identification at check-in.
• Check-in time is 14:00:00 and check-out time is 10:00:00.
• The number of guests must not exceed the maximum occupancy stated for the room or service.
• Extra guests may incur additional charges.
• We reserve the right to refuse or cancel any booking at our discretion.

06 Payments & Refunds

All prices are listed in ZMW and include applicable taxes unless stated otherwise.

Refunds are processed within 7–14 business days to the original payment method, subject to cancellation policy.

07 Cancellation Policy

Cancellation fees apply based on how close to the booking date the cancellation is made:

• Free cancellation: up to 48 hours before check-in.
• Late cancellation: 20% of the booking value may be charged.
• No-show: full booking amount may be charged.

08 User Conduct

You agree not to:

• Use our services for any unlawful purpose.
• Harass, threaten, or discriminate against other guests or staff.
• Damage property, engage in vandalism, or cause disturbance.
• Smoke in non-smoking areas or violate fire safety regulations.
• Use the platform to transmit viruses, spam, or harmful code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Impersonate another person or entity.

Violation of these rules may result in immediate removal from the premises and/or termination of your account without refund.

09 Intellectual Property

All content on this platform — including text, graphics, logos, images, and software — is the property of Kapaz Cafe or its licensors and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

10 Limitation of Liability

To the fullest extent permitted by law, Kapaz Cafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

We are not responsible for loss or damage to personal belongings, theft, acts of God, or events beyond our reasonable control.

11 Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using our services, you consent to the collection and use of information as described in the Privacy Policy.

12 Changes to Terms

We reserve the right to update or modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

Your continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.

13 Termination

We may suspend or terminate your access to our services at any time, without prior notice, if:

• You violate these terms.
• We are required to do so by law.
• Your conduct harms other guests, staff, or our business.
• Your account remains inactive for an extended period.

Upon termination, your right to use our services immediately ceases. Any outstanding payments remain due.

14 Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Zambia.

Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Zambia.
